California has stiff penalties for driving under the influence (DUI). A first offense is a misdemeanor. However, if you cause an injury, or if it is your third offense, you can be charged with a felony, which means you will probably serve jail time, lose your driver’s license and pay steep fines. Shasta County DUI Penalties

Under California law, refusing to take a blood or breath test results in a one-year license suspension. People age 21 or older who produce results of .08 percent blood alcohol content (BAC) or greater in a blood or breath test will face the following penalties:

  • First offense — automatic license suspension for four months
  • Second offense within 10 years — a one-year license suspension

A first DUI/DWI offense with a BAC of .15 percent or more requires you to have an ignition interlock device (IID) installed on your vehicle.

A Vigorous Defense

I will try to eliminate any prior DUI/DWI convictions so they cannot be used against you. I will also argue against IID installation.

Determining the validity of your arrest and the admissibility of the evidence is one of the most important parts of a DUI/DWI defense. Breathalyzer tests, blood tests and field sobriety tests must be examined carefully. If the tests have been administered incorrectly, I may be able to get the results suppressed or dismissed.
